Terms and Conditions of Use

By clicking “I Agree” or accessing or using the survey platform (the “Platform”) provided by Room to Act, Inc. (“We” or “Room to Act”), you (“You”), on behalf of the company you represent (such company that you represent, Your “Corporate Participant” and any such company that uses the Platform generally, a “Corporate Participant”), agree to be bound by these Terms and Conditions (these “Terms”) and the Privacy Policy incorporated herein by reference. If You do not agree, do not access or use, and do not enable Your Corporate Participant's other representatives to access or use, the Platform.

1. Survey Participation and Process

  • The Platform is designed for corporate organizational use, where one authorized representative from the Corporate Participant first provides basic demographic and company information.
  • Following that, multiple executives or representatives from the Corporate Participant may complete individual survey responses.
  • It is anticipated that multiple Corporate Participants will use the Platform by having their respective representatives participate in the survey.

2. Data Use and Confidentiality

  • We may retain and associate a Corporate Participant's identifying information (e.g., company name, industry, region) with its submitted survey responses for internal analysis and research.
  • However, unless otherwise explicitly agreed in writing:
    • Survey responses will be aggregated and reported in a manner that does not identify specific Corporate Participants or respondents.
    • Individual-level answers will be anonymized in any public reports or external disclosures.
  • Each Corporate Participant will receive access to its own aggregate survey responses for internal use.

3. Confidentiality

All non-public information submitted by a Corporate Participant or its representatives is considered confidential and will not be disclosed to third parties, except:

  • As required by law;
  • With the prior written consent of such Corporate Participant;
  • In anonymized and aggregated format as described above.

4. Privacy and Personal Data

Your use of the Platform, and Your Corporate Participant's other representatives' use of the Platform, is also governed by our Privacy Policy, which explains how We collect, use, and safeguard personal and demographic data, including:

  • Collection of names, roles, and company affiliations for survey authentication and analysis;
  • Use of cookies or similar technologies for session integrity;
  • Data retention and deletion rights in accordance with applicable data protection laws, including CCPA/CPRA and GDPR, if applicable.

By agreeing to these Terms, You consent, on behalf of Your Corporate Participant, to the collection and processing of personal and organizational data as described in the Privacy Policy as it pertains to Your Corporate Participant, You and Your Corporate Participant's other representatives.

5. Permitted Use of Information

The Company grants each Corporate Participant a limited, non-exclusive, revocable right to:

  • Participate in the survey for legitimate internal or research purposes;
  • Access and review such Corporate Participant's results;
  • Use such Corporate Participant's response summary for non-commercial internal evaluation.

You may not:

  • Reverse engineer, re-identify, or de-anonymize aggregated data;
  • Share or publish your results in a misleading or deceptive context;
  • Reproduce or redistribute the Platform or survey content without permission.

6. Intellectual Property

All content, questions, software, and analytics on the Platform are the exclusive property of Room to Act or its licensors. All rights are reserved.

7. Disclaimer and Limitation of Liability

The Platform is provided “as is” without warranties of any kind, express or implied. We do not guarantee accuracy or completeness of the aggregated data, or availability or error-free operation of the Platform.

To the maximum extent permitted by law, Room to Act disclaims liability for any direct, indirect, or consequential damages arising from Your use, and Your Corporate Participant's other representatives' use, of the Platform, including loss of data, revenue, or business opportunity.

8. Termination

We reserve the right to suspend or terminate access to the Platform for any user who violates these Terms or misuses the Platform.

9. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of laws principles.

10. Amendments

We may modify these Terms from time to time. Any changes will be posted on this page, and continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
